The customer is not always right. In this instance, the customer was not only wrong, he committed unlawful acts and was arrested.

75-year-old Florida resident, David Gulley pulled out a steak knife and “lunged at a patron at a nearly table at Rumson restaurant, Red Horse By David Burke after an argument over wine being spilled on the victim’s wife,” according to the police. The victim’s finger was cut, but he refused treatment.

Gulley also punched the manager with an open fist.

The Actual Police Statement

According to Rumson-Fairhaven Retrospect, On Aug. 22 at approximately 8:30 p.m., patrol officers were dispatched to a local restaurant after receiving a 911 report of a “man that pulled a knife” on another patron.

Patrols responded and took the suspect, David Gulley, 75, of Palm Beach Shores, Florida, into custody after witnessing him strike the manager in the side with a closed fist as they arrived.

Witness statements and cell phone footage of the incident confirmed that Gulley had brandished a steak knife and lunged at the victim after an argument over wine being spilled on the victim’s wife. The victim suffered a lacerated finger and refused medical treatment at the scene.

Gulley was charged with the following offenses by Patrolman James Camilleri and released on a summons:

• Aggravated Assault

• Possession of a Weapon for an Unlawful Purpose

• Terroristic Threats

• Disorderly Conduct

• Simple Assault

According to the Asbury Park Press, Chef David Burke said he was on a call with the restaurant's management that evening.

“I thought they did any excellent job," he said. "I mean they did exactly as they should have done. They tried to diffuse it and they called the police."
